Mayne Pharma (MYX.AX) rises after settling IMVEXXY patent litigation with Sun Pharma

Mayne Pharma shares rose up to 2.1% after it agreed to settle US patent litigation with India’s Sun Pharma over IMVEXXY and FDA Orange Book patents, with an agreed pathway for a potential generic entry on Oct 21, 2032, or earlier under certain circumstances.

Mayne said it filed the lawsuit in July 2024 after a notice showed Sun Pharma had submitted an abbreviated new drug application to the FDA seeking approval for a generic version of IMVEXXY, a vaginal insert used to reduce pain during sexual intercourse after menopause. The settlement creates an agreed pathway for possible future entry of a Sun Pharma generic product on October 21, 2032, or earlier in certain circumstances, subject to court approval of the settlement terms, the company said.

Mayne said the settlement does not include any financial payment or upfront monetary consideration between the parties. 7% year to date.
