Viatris asks US court to clear Wegovy generic from Novo patent claims
Mylan Pharmaceuticals, part of Viatris, filed in Delaware federal court seeking a ruling that its proposed Wegovy generic would not infringe Novo Nordisk's patent rights.
By Blake Brittain Sept 25 (Reuters) — Generic drugmaker Viatris has sued Danish pharmaceutical giant Novo Nordisk in Delaware federal court, seeking a ruling that its proposed generic of Novo's blockbuster GLP-1 drug Wegovy would not violate Novo's patent rights. Viatris' Mylan Pharmaceuticals asked the court in a filing made public on Thursday to find that its generic would not infringe Novo's patent covering a method of administering single-dose Wegovy pens for weight loss. A Novo spokesperson declined to comment on the lawsuit on Friday, citing pending litigation. Spokespeople for Viatris did not immediately respond to a request for comment on the lawsuit.
Novo earned nearly $31 billion from its blockbuster semaglutide-based weight loss drugs Wegovy and Ozempic last year, according to a company report. Generic versions of Wegovy and Ozempic cannot enter the US market until 2032, when Novo patents covering the drugs' active ingredient semaglutide expire. Novo has settled other patent lawsuits over proposed Wegovy and Ozempic generics against Mylan and other drugmakers. The case is Mylan Pharmaceuticals Inc v.
